1. Introduction and Acceptance

1.1 Agreement to Terms

Welcome to HAVIT! These Terms of Use ("Terms") govern your access to and use of the HAVIT mobile application, websites, and related services (collectively, the "Services") provided by AI CONNECT Inc. ("HAVIT," "we," "us," or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

2. Changes to Terms

We may modify these Terms at any time. For material changes, we will provide at least 30 days' notice via in-app notification, email, or website posting. Continued use after the effective date constitutes acceptance.


3. Eligibility and Account Registration

3.1 Eligibility Requirements

To use the Services, you must be at least 18 years old, not be barred from using HAVIT under applicable law, and not be located in a country subject to U.S. or Korean government sanctions.

3.2 Sensitive Health Information (Separate Consent Required)

IMPORTANT: To use personalized wellness features, you will be asked to provide health-related sensitive information through a SEPARATE consent process including health conditions, medications, medical history, and ethnic origin.

This consent is presented separately from these Terms, is voluntary, revocable at any time, and recorded with timestamp for compliance purposes.


4. Important Health and Medical Disclaimers

HAVIT IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE.

No doctor-patient or healthcare provider relationship is created. The Services provide general wellness insights, estimates, and habit-support tools only. All recommendations are informational and educational in nature.

You should always consult a qualified healthcare professional before making any decisions that may affect your health.

4.1 Who Should Consult a Doctor

We strongly recommend consulting your healthcare provider before using HAVIT if you: are pregnant or breastfeeding, are underweight (BMI < 18.5), are under 18 or over 80, have a diagnosed eating disorder, have type 1 diabetes, or have any medical condition that may be affected by diet or exercise changes.

4.2 No Guaranteed Results

We make no guarantees concerning the level of success you may experience. Results will differ for each individual based on factors including genetics, adherence, health conditions, and lifestyle.


5. AI Body Composition Estimates

HAVIT uses proprietary AI algorithms to estimate your body composition based on survey responses, physical measurements you provide, and ethnicity and age-based statistical models.

THESE ESTIMATES ARE STATISTICAL APPROXIMATIONS DERIVED FROM MACHINE LEARNING MODELS AND ARE NOT EQUIVALENT TO ACTUAL MEASUREMENTS.

Estimated values may differ significantly from measurements obtained through devices such as InBody, DEXA scans, or other medical-grade analyzers. Estimates should be used for general wellness tracking only, not for medical diagnosis, treatment decisions, or medication dosing.

Your S-L-M Profile categorizes your wellness journey based on:


7. Six-Factor Wellness Plans

Based on your profile, HAVIT generates personalized daily targets for: Calories, Protein, Hydration, Steps, Sleep, and Weigh-ins. Targets are calculated using validated formulas and are general wellness guidelines, not medical prescriptions.


8. Havi AI Coach

Havi is your AI-powered wellness companion using large language model technology from OpenAI, Anthropic, and Google to provide personalized guidance and motivation.

Havi is not a human coach, licensed therapist, registered dietitian, or medical professional. Havi's responses are generated by AI and may contain errors. Please contact appropriate human professionals for medical emergencies, mental health crises, or specific medical advice.


9. User-Generated Content

You retain ownership of content you create or upload. By uploading content, you grant HAVIT a non-exclusive, worldwide, royalty-free license to store, display, and process your content to provide the Services.


10. Intellectual Property

HAVIT and its licensors own all rights in the HAVIT app, website, Services, branding, AI models, and content library. We grant you a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes.


11. Third-Party Integrations

HAVIT may integrate with Apple HealthKit, Google Health Connect, WhatsApp, and Social Login Providers. Data from HealthKit and Health Connect is NEVER used for advertising, sold to third parties, or used for insurance decisions.


12. Subscriptions and Payments

HAVIT offers both free features and premium subscription plans. Subscriptions auto-renew unless cancelled before the renewal date. Payments are processed through App Store or Google Play.


13. Privacy and Data Processing

Our collection and use of your information is governed by our Privacy Policy. Processing of sensitive health data requires separate, explicit consent obtained through a dedicated consent screen during onboarding.


14. Disclaimers of Warranty

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.


15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI CONNECT INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.


16. Dispute Resolution

Before filing any claim, you agree to contact us at help@aiconnects.me and attempt to resolve the dispute informally for at least 30 days. If informal resolution fails, disputes shall be resolved through binding arbitration administered by the Korean Commercial Arbitration Board (KCAB) in Seoul, Republic of Korea.

CLASS ACTION WAIVER: YOU AGREE TO RESOLVE DISPUTES ONLY ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS OR CLASS ARBITRATIONS.


17. Governing Law

These Terms are governed by the laws of the Republic of Korea. For disputes not subject to arbitration, you consent to the exclusive jurisdiction of the courts in Seoul, Republic of Korea.


18. General Provisions

These Terms, together with the Privacy Policy, constitute the entire agreement between you and AI CONNECT Inc. If any provision is found unenforceable, the remaining provisions continue in effect. You may not assign your rights under these Terms.


19. Medical Disclaimer (Summary)

HAVIT IS A WELLNESS APPLICATION, NOT A MEDICAL DEVICE.

  • AI body composition estimates are not clinical measurements
  • Personalized recommendations are general wellness guidance
  • Always consult healthcare professionals for medical decisions
  • Do not use HAVIT to diagnose, treat, or prevent any medical condition

Addendum A: Korea-Specific Terms

Nothing in these Terms limits your rights under the Korean Consumer Protection Act or E-Commerce Act. Under Korean law, you may withdraw from digital content purchases within 7 days. You may seek resolution through Korea Consumer Agency (1372) or KISA (118).

Addendum B: EU/EEA-Specific Terms

Nothing in these Terms affects your statutory rights under EU consumer protection law. You have 14 days to withdraw from a purchase. You have additional rights under GDPR as described in our Privacy Policy. Processing of special category data is based on your explicit consent (Article 9(2)(a)).


Addendum C: United States-Specific Terms

The arbitration agreement is governed by the Federal Arbitration Act. California residents may contact the Complaint Assistance Unit at 1625 North Market Blvd., Sacramento, CA 95834, or (916) 445-1254. Under CPRA, health information and ethnic origin are classified as "sensitive personal information" requiring explicit opt-in consent.
